Explosionsgefährliche Stoffe; Beantragung eines Sprengstofferlaubnisscheins oder eines Befähigungsscheins

Beim Umgang mit explosionsgefährlichen Stoffen sind die Anforderungen des Sprengstoffgesetzes (SprengG) zu beachten. Daher dürfen in der Regel nur Personen mit explosionsgefährlichen Stoffen umgehen, die im Besitz einer sprengstoffrechtlichen Erlaubnis oder eines Befähigungsscheines sind.

Description

Tätigkeiten im Zusammenhang mit explosionsgefährlichen Stoffen besitzen ein großes Gefahrenpotential. Ziel des Sprengstoffgesetzes ist es, Menschen und Sachen vor diesen Gefahren zu schützen. Unsachgemäßer Umgang durch Personen ohne Fachkunde sowie Missbrauch oder Unfälle durch Missachtung der Sicherheitsbestimmungen sollen verhindert werden. Das Sprengstoffrecht stellt hohe Anforderungen an Eignung, Zuverlässigkeit und Fachkunde der Personen, die mit explosionsgefährlichen Stoffen gewerblich oder privat umgehen.

Umgang und Verkehr mit explosionsgefährlichen Stoffen sind im Sprengstoffgesetz (SprengG) und den Verordnungen zum Sprengstoffgesetz (1.+ 2. + 3. SprengV) geregelt.

Zuständige Behörden:

Die Kreisverwaltungsbehörden sind zuständig für Erlaubnisse im Privatbereich für Böllerschützen, Wiederlader und Vorderlader.
Die Gewerbeaufsichtsämter sind zuständig für Erlaubnisse und Befähigungsscheine im gewerblichen Spreng- und Feuerwerkswesen sowie für sonstige Erlaubnisse im Privatbereich.
Die Bergämter sind zuständig für Unternehmen, die entsprechende Tätigkeiten unter Bergaufsicht ausüben.

Prerequisites

Voraussetzungen für die Erteilung einer sprengstoffrechtlichen Erlaubnis oder eines Befähigungsscheins sind in der Regel:

Zuverlässigkeit
Persönliche (und körperliche) Eignung
Fachkunde
Mindestalter von 21 Lebensjahren
(Gewerbliches oder privates) Bedürfnis

Deadlines

Eine Erlaubnis oder ein Befähigungsschein kann nur erteilt werden, wenn alle Voraussetzungen erfüllt sind.
