According to Art. 24 of the Bavarian Local Public Transport Act (BayÖPNVG), the municipal authorities are granted annual aid for training transport in general local public transport on application.
This form can be submitted electronically (e.g. via a secure contact form using your user account with login via the electronic ID function or the ELSTER certificate) or handwritten and signed in paper form to the responsible authority.
The transport companies receive a compensation payment in accordance with Section 45a PBefG for the reduction for school pupils and trainees in local public transport.
Compensation is paid for 44% of the difference between the revenue from the reduced tickets and the average transport-specific costs, which are calculated on the basis of the criteria set out in the Compensation Ordinance.
Upon application, the transport company receives compensation for the reduction in the price of tickets for trainees compared to the Everyman Ticket in accordance with the provisions of Section 45a PBefG and the Compensation Ordinance.
The transport operator must be a permit holder or operator on the local public transport line in accordance with § 42 PBefG or on a regular service in accordance with § 43 No. 2 PBefG.
Another requirement is that the income from the trainees' transportation fees is not sufficient to cover the transport-specific costs and that the operator has applied for an adjustment of the transportation fees to the income and cost situation within a reasonable period of time.
The governments are responsible for the procedure.
If the objection has no suspensive effect, an application for suspension of enforcement can be made to the original authority or the objection authority in accordance with Section 80 (4) VwGO. Instead, an application for an order or restoration of the suspensive effect of the objection can be made to the competent Bavarian Administrative Court in accordance with Section 80 (5) VwGO.
Please note: If it concerns the demand for public charges and costs (§ 80 Para. 2 Sentence 1 No. 1 VwGO), an application to the court is generally only admissible if the authority has previously rejected an application for suspension of enforcement (§ 80 Para. 6 VwGO).
