Register of Craftsmen; Certificates of exemption as prerequisites for registration in the Register of Craftsmen

If you have not successfully passed either a German examination for the master craftsman's diploma or an equivalent examination for the skilled craft or trade liable to a license you wish to practice, you still have the opportunity to apply for a practicing permit or a certificate of exemption.

Description

The granting of a practicing permit or certificate of exemption for a skilled craft or trade liable to a license (cf. Appendix A to the German Handicrafts Regulation Act) permits your registration in the Register of Craftsmen. Execution of the registration in the Register of Craftsmen allows self-employed (independent) practice of the applied skilled craft or trade.

Prerequisites

Practicing permit for an additional trade or business pursuant to Article 7a of the German Handicrafts Regulation Act (HwO)

  • The  applicant is already registered in the Register of Craftsmen with a skilled craft or trade listed under Appendix A
  • supporting documents evidencing the subject-specific theoretical knowledge and practical skills in the skilled craft or trade for which the practicing permit is requested.
  • It is also possible to limit the practicing permit to a substantial section.

Practicing permit in accordance with Article § 7b of the German Handicrafts Regulation Act (HwO) (Senior Journeymen's Regulation)

  • Pertinent skilled crafts examination or appropriately recognized skill or trade requiring formal training
  • at least six (6) years of work experience gained in this field (while actually practicing the craft or trade), of which a total of four (4) years were spent in a senior position (independent decision-making authority)
  • cannot be issued for the skilled crafts and trades of chimney sweep, optometrist, hearing-aid acoustician, orthopedic technician, orthopedic shoemaker, or dental laboratory technician

Certificate of exemption pursuant to Article 8 of the German Handicrafts Regulation Act (HwO)

  • Existence of an exceptional case: Taking into account all factors relevant to the circumstances of the individual case, the sitting of the examination for the master craftsman's diploma would constitute an unreasonable burden (e. g. existence of other qualified examinations; outsourcing; health problems or physical disabilities; advanced age with long-term work experience; closely limited specialist work)
  • Knowledge and skills in the practical, subject-specific theoretical, and business-management specific areas necessary for the management of a craftsman's business
  • Granting of the certificate of exemption may be subject to certain conditions or prerequisites, or for a limited period of time; or the certificate of exemption may be limited to a sub-section of the skilled craft or trade.

Certificate of exemption for nationals of the EC or EEA member states pursuant to Article 9 Para. 1 of the German Handicrafts Regulation Act (HwO)

The procedure in accordance with the EU-EEA Skilled Crafts and Trades Ordinance provides nationals of EU or EEA member states or Swiss nationals with easier access to a proof or certificate of qualification. A certificate of exemption will be granted to anyone in possession of the required work experience as defined by Article 2 Paras. 2 and 3 of the EU-EEA Skilled Crafts and Trades Ordinance in the trade or business concerned. However, special provisions apply to optometrists, dental laboratory technicians, hearing-aid acousticians, orthopedic technicians, and orthopedic shoemakers. The work activities in the person's country of origin should not have ceased more than ten (10) years ago.

The relevant procedure must have been completed prior to the application for registration in the Register of Craftsmen.

    • EU Certification (99/42) by the competent authority in the country of origin - in accordance with the Official Journal of the European Communities Official No. C 81/8 of 13 July 1974 for proof of self-employed (independent) activities
    • Supporting documents evidencing the person's vocational training (certificates/diplomas) presented as certified copies
    • Supporting documents evidencing the person's nationality
    • If necessary, please provide additional documents depending on the circumstances of the particular case
